APPROVED - Conditional Use Permit | Ste-Bil Dirt Pit Request

Summary:
Mr. Hollowell summarized the Planning Commission recommendation for approval with three conditions:
Mine must only be used for the duration of the Highway 7 expansion project
Development must comply with MS Surface Mining and Reclamation rules
No work shall begin until erosion control measures are in place and developer has provided MDEQ-required documentation
Mr. Hollowell stated the recommended approval was for four acres only (inclusive of the road), though did not include that as a condition. Note this is inconsistent with the first line of the application in which the applicant states it is seeking approval for its "Conditional Use Application for a 165.21-acre parcel of land."
Supervisor Bynum confirmed with Mr. Hollowell that any mining outside the 4 acres would require coming back to the Board for expansion of the conditional use permit. Again, this cannot be found in the application itself or the conditions for approval.
Supervisor Morgan confirmed with Mr. Hollowell that timber harvesting does not require permission from the Board.
Supervisor Gordon asked how close the dirt mine was to the closest residence. Mr. Hollowell responded he didn't have the site plan in front of him (though it was in the meeting packet) and those measurements weren't included on the site plan anyhow. He stated the requirement is that it be 100' from property lines.
Other supervisor questions centered on whether the developer would have sufficient dirt from the proposed site and sufficient time to extract the dirt they desired. Mr. McCurdy, speaking on behalf of the applicant Ste-Bil, indicated they needed 80,000 yards of dirt and needed approval to operate for three years.
There was brief discussion around another condition recently recommended for a different dirt mine on CR 313 (where Planning Commissioner Kate Rossen indicated she lives). That condition would require operations not begin until after 9am to minimize impact to traffic patterns. Mr. McCurdy indicated "The 9am thing...We can't do that." Work needed to be done "daylight to dark." Restricted hours of operation were not included as a condition of approval.
Scott Allen (District 4) motioned to approve with the three Planning Commission conditions and two additional conditions related to increased road signage and keeping the road swept. It was seconded by Mr. Bynum (District 5).
Approximately 20 people in the audience held up signs reading "No!!"
The Board voted unanimously to pass it.
Observations:
There was no discussion of any of the public objections raised by more 40 county residents in the Planning Commission hearing, the prior Board of Supervisors hearing, or via written submission to the Supervisors or planning staff.
There was no discussion of a procedural appeal that was left unresolved as of the prior Board meeting on May 18th and was ostensibly the reason that prior vote was tabled.
Three times throughout the discussion audience members had to ask that the Board and speakers raise their voice so the discussion could be heard.
The application supporting this request was not included in the published meeting materials.
Only a handful of the many written public objections were included in the published meeting packet.

Small Business Administration Update
Summary:
SBA rep summarized status of disaster relief efforts and requested Supervisors let their constituents know about upcoming June 10th deadline for SBA and FEMA applications.
Everyone needs to see how these elected officials completely and routinely ignore the voices of the citizens…at the last meeting where the Dirt mining vote was tabled the BOS members present were handed stacks of information that HAD THEY BOTHERED to read would have given rise to questions…the questions they attempted to ask so it looked like they cared were unrelated! But the worst part was when the Developer J.W. McCurdy refused to accept the SAME limitations the PC imposed regarding hours of operations on a small African American dirt mine…he said “That’s not gonna work for me. There isn’t a single dirt mine in the county that has to do that except the one your talking about.” The Supervisors…
